Compliance
2257 statement.
Last updated May 12, 2026.
Summary
Nyhilism operates an advertising marketplace. We do not produce, film, photograph, or otherwise create any visual depictions of sexually explicit conduct ourselves. Every image and link that serves through our network is uploaded by a third party — an advertiser uploading a creative, or a publisher registering inventory on a site they own.
To the extent any uploaded creative or publisher inventory falls within the scope of 18 U.S.C. § 2257, the original producer of that content is the entity responsible for the underlying performer records. Nyhilism is a downstream conduit and qualifies for the third-party content provider treatment under 28 C.F.R. § 75, but we maintain a custodian-of-records contact (below) to receive inquiries and route them to the responsible producer.
Custodian of records
Alpha note
Nyhilism does not host primary producer content on its origin servers; we serve banner creatives only. The custodian-of-records mailing address below will be finalized before GA. Until then, 2257 inquiries should be sent to the email address — we will respond within the same SLA.
Nyhilism — Custodian of Records
Attn: 2257 Custodian Nyhilism, Inc. Mailing address pending — see alpha note above United States
Email: [email protected]
The custodian receives inquiries about specific creatives or inventory and routes the requester to the producer of record who maintains the underlying performer documentation.
Producer obligations
Every advertiser and publisher using Nyhilism agrees, under the Terms of Service, to maintain the records required by 18 U.S.C. § 2257 and 28 C.F.R. § 75 for any content depicting performers in sexually explicit conduct that they upload, link to, or place on inventory they monetize through us.
If you upload material to Nyhilism, you represent that:
- Every performer depicted was 18 years of age or older at the time the material was produced.
- You have on file a copy of a valid government-issued photo identification for each performer.
- You maintain the records in the form, manner, and location required by 28 C.F.R. § 75 (or you are exempt under 18 U.S.C. § 2257A and have filed the corresponding certification).
- You will produce those records to the appropriate Department of Justice inspector during the inspection windows required by statute.
What we do on top of that
We don’t rely solely on uploader representations. The following safeguards run on every piece of content that touches the network:
- Age gate at signup.Date of birth is collected and verified before any account is created. Accounts that fail the 18+ check don’t exist.
- Human review queue. Every uploaded creative image sits in a review queue before it serves. An administrator reviews each one against the prohibited-content list in the Terms.
- PhotoDNA scan — planned before GA. Integration with Microsoft PhotoDNA is on the roadmap; once enabled, every upload will be hashed and checked against the database before approval, with hash matches rejected and the account referred for investigation. Today, the human review queue is the gate.
- SiteScan on publishers.Publisher sites are scanned at onboarding and rescanned periodically. The scanner flags missing 2257 statements and missing age-gate language as compliance findings against the publisher’s score.
- Logging + retention. Every upload, approval, rejection, and takedown is logged with a timestamp and the acting user, retained for the period required to respond to lawful inquiries.
Reporting non-compliance
If you believe a creative or publisher inventory served through Nyhilism violates 18 U.S.C. § 2257 — including but not limited to material that may depict a performer under the age of 18 or a performer who has not consented — report it immediately to [email protected].
For copyright takedowns, use the DMCA process. For other content concerns, email [email protected].
Reports of material depicting a minor are also reportable to the National Center for Missing & Exploited Children at report.cybertip.org. We file reports there as required by 18 U.S.C. § 2258A.
Exempt classification
Nyhilism itself does not create, edit, manage, or select the visual depictions that pass through the marketplace. Under the analysis in 28 C.F.R. § 75.1(c), our role is limited to the transmission, storage, retrieval, hosting, formatting, and translation of third-party content. We assert the exempt third-party content provider classification on that basis, while continuing to maintain the custodian-of-records contact above for the benefit of any inspector or rights-holder who reaches us first.
