Agreement
Terms of service.
Last updated May 13, 2026.
Acceptance
By signing up, you accept these Terms on behalf of yourself and any entity you represent. The person signing up represents that they have authority to bind that entity. If you signed up on behalf of a company that turns out not to authorize the account, you’re personally on the hook for the activity.
Eligibility & age
You must be 18 years old or the age of majority in your jurisdiction (whichever is greater) to use Nyhilism. We collect date of birth at signup and decline accounts that fall short. Signup is also closed to residents of jurisdictions where the service or adult content distribution is prohibited.
KYC & sanctions
We screen every account against U.S. OFAC sanctions lists at signup and re-screen on material changes (new payout address, new funding instrument). Accounts that hit the sanctions list are declined or, if discovered post-signup, frozen pending documentation.
For advertisers with significant spend (above $5,000 USD in a calendar month) or publishers crossing $10,000 USD in earnings, we may request additional Know-Your-Customer documentation: government-issued ID, proof of business registration, and a beneficial-ownership statement. These thresholds align with the requirements of our payment processors and the contemporary FinCEN guidance on adult industry money flows.
Knowingly providing false KYC information is a material breach and grounds for immediate termination plus referral to the affected processor and law enforcement.
Acceptable use
All accounts agree to the Acceptable Use Policy, which lists categorical content bans, creative + landing-page restrictions, publisher restrictions, and the enforcement ladder. The AUP is incorporated into these Terms by reference; updates to it follow the same Changes process.
Your account
- One organization per account. Don’t register multiple accounts to evade suspensions, scoring, or rate limits.
- Keep your credentials confidential. You’re responsible for everything that happens through your account.
- Notify us at [email protected] if you suspect unauthorized access.
- You may delete your account at any time. Some data persists after deletion for legal and accounting reasons (see Privacy).
Publisher terms
If you register as a publisher:
- You own or have the right to monetize the domain you register. We verify ownership at first tag fire or by DNS / well-known file.
- Your inventory is scanned at onboarding and rescanned monthly. Findings affect your visible quality score and are not negotiable on a per-site basis.
- You agree not to run competing ad-network code on the same zones, generate impressions through bots, automation, or incentivized traffic, or otherwise manipulate the traffic-integrity signals.
- We may suspend your account or any specific zone for traffic-integrity violations. Where suspension is for invalid-traffic ratios, the threshold and our findings are visible in your dashboard.
- Earnings accrue at the publisher share rate (currently 70% of served CPM, subject to change with notice). Invalid impressions don’t pay out.
Advertiser terms
If you register as an advertiser:
- You own the rights to every creative you upload, or have the necessary license. You’re responsible for 2257 compliance on any material that depicts performers.
- You consent to automated and human moderation of uploaded images. Creatives may be rejected for any of the reasons in Prohibited content. You consent to PhotoDNA hash scanning once that integration is enabled (planned before GA); hash matches will be rejected and logged.
- Your creatives are reviewed before they serve. We may reject a creative for any of the reasons in Prohibited content, and our decision is final unless you can demonstrate the rejection was clearly in error.
- You set a daily budget per campaign. Once spend hits the budget, the campaign pauses automatically until the next budget window.
- You don’t pay for impressions flagged as invalid by the traffic-integrity system.
Payments, refunds, chargebacks
Advertiser charges
Auction-spend deposits clear through high-risk processors (CCBill / Epoch / Segpay). Direct-buy zone bookings clear through Escrow.com. Both rails settle in USD; conversion is on you.
Publisher payouts
Earnings are paid out on a rolling schedule once your balance clears the minimum threshold ($50 default). Payout rails: Paxum, USDT-TRC20, and bank wire. Fees on each rail are passed through; we don’t mark them up.
Refunds
We refund invalid-traffic charges automatically — the deduction happens before the invoice is closed, so you never pay for it to begin with. Outside that, we don’t issue refunds for campaign spend on valid impressions. The full policy with processing times and fee pass-through is at /refunds; refund requests go to [email protected] within 30 days of the charge.
Chargebacks
Initiating a chargeback before contacting us is a material breach of these Terms. We’ll suspend your account, contest the chargeback through the processor’s representment workflow, and may pursue collection of the disputed amount plus processor fees plus reasonable costs of collection. Full policy including representment evidence and account consequences is at /chargebacks.
Suspension & termination
We may suspend or terminate an account for any of the following:
- Violation of Prohibited content (below) or the Acceptable Use Policy.
- Failure to satisfy KYC documentation requests within 14 days of a request.
- OFAC / sanctions-list match (with no fault required).
- Repeated traffic-integrity violations (publishers) or repeated creative rejections (advertisers).
- Chargebacks without prior contact (advertisers).
- DMCA repeat infringement — see DMCA.
- Operating multiple accounts to evade suspension, scoring, or rate limits.
- Fraud, misrepresentation, or unlawful activity.
- Non-payment, insolvency, or sanctions / OFAC list activity.
Termination for the above is at our discretion and may be immediate. Where it’s related to traffic integrity or creative compliance, you’ll see the underlying findings in your dashboard.
Prohibited content
Nyhilism is an adult network — adult content is the point. The following is nevertheless prohibited, full stop:
- Any material involving minors. Includes simulated, AI-generated, and animated depictions.
- Non-consensual material of any kind.
- Material that violates 2257 record-keeping requirements (US 18 U.S.C. § 2257).
- Bestiality, necrophilia, or content depicting serious self-harm.
- Sale of illegal goods or services, including counterfeit credentials, fraudulent financial products, drugs scheduled under the Controlled Substances Act, and human trafficking.
- Malware, browser exploits, scareware, fake software updates, or any creative that misrepresents itself as a system message.
- Content that infringes a third-party copyright, trademark, or right of publicity.
Intellectual property
Nyhilism, the Nyhilism mark, the SiteScan scoring methodology, and the platform itself are our property. You retain ownership of any content you upload (creatives, site metadata), and grant us a non-exclusive worldwide license to host, transmit, scan, and display it for the purpose of operating the service.
Copyright complaints by third parties are handled through the DMCA process.
Limitation of liability
To the maximum extent permitted by law, Nyhilism is not liable for indirect, incidental, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data. Our aggregate liability under these Terms in any 12-month period is capped at the greater of (a) the amount you paid us in that period, or (b) $100 USD.
The service is provided “as is” — without warranty of uptime, fitness for a particular purpose, or non-infringement. We give it our best shot but we’re not guaranteeing the ad-server never has an outage or the marketplace never has a slow Tuesday.
Disputes & governing law
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. Disputes are resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules, seated in Wilmington, Delaware, except that either party may bring an individual action in small-claims court if it qualifies, and either party may seek injunctive relief in court for IP infringement or unauthorized access.
No class actions, no consolidated arbitration. If a court holds this clause unenforceable, the rest of the Terms still applies.
Changes
We’ll update these Terms over time. Material changes are announced in your dashboard at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
